During the sexual assault trial and aftermath, she had a sister who was dubbed “Tiffany Doe” or “Jane Doe 2.” Her book may include detailed details on her family. At the time of her assault, she was a graduate of a different college.
Sexual Assault:
On the night of January 17, 2015, Miller was at a party at Stanford University’s Kappa Alpha Fraternity. Brock Turner, a Stanford freshman on a swimming scholarship, was also present at the party. He was 19 at the time. At the party, they got along swimmingly, sipping beers and dancing. On the 18th of January 2015, they left the party at 1 a.m. to return to his hostel. They were walking together, hands in each other’s. Turner got down on the ground and started kissing Miller after Miller stumbled on a hill behind a wooden shed behind a dumpster. Miller responded yes when Turner asked if she wanted to “finger” her. For a minute, Turner “fingered” Miller.
Turner was discovered on top of Miller by two Swedish graduate students when she was unconscious. Turner bolted from the scene after they challenged him. One student pursued Turner, while the other checked to see if Miller was breathing. Miller had substantial trauma and piercing trauma, according to a nurse who completed a Sexual Assault Respons Team evaluation at the hospital. Miller claimed she couldn’t remember anything about the incident. She also claimed that she had no recollection of making phone calls to her sister. Before being hauled away by EMS, she had vomited on the scene.
Sexual Assault Charges:
On January 20, Stanford barred Turner from the campus, and USA Swimming barred Turner from ever competing in a competitive swimming event for the United States. Turner was charged with two charges of rape, two counts of penetration, and one count of assault with intent to rape on January 28, 2015, following the investigation.
1. Harassment of a drunken person
2. rape of a person who is unconscious
3. an unconscious woman’s sexual penetration (by a foreign object)
4. a drunk woman’s sexual penetration (by a foreign object)
5. Harassment with the intent to rape
There was no genetic evidence of genital-to-genital contact after DNA testing. As a result, at a preliminary hearing on October 7, 2015, the two rape accusations were withdrawn.
Trial, Sentence:
On March 14, 2016, the trial People v. Turner in Santa Clara County Superior Court began. Turner was convicted of three felonies on March 20, 2016, including assault with the intent to rape an intoxicated woman, sexually penetrating an intoxicated person with a foreign instrument, and sexually penetrating an unconscious person with a foreign object.
He was sentenced to six years in prison by prosecutors. Turner was sentenced to six months in the Santa Clara County Jail on June 2, 2016, followed by three years of probation by Judge Aaron Persky. He was marked as a sex offender for the rest of his life. Turner was imprisoned for three months in Santa Clara County. On September 2, 2016, he was released.
Controversy:
Judge Persky’s sentencing was attacked by prosecutors and victims’ rights groups as mild and biased. They began a campaign to overturn Persky’s sentence. Michele Dauber, a Stanford Law School professor and lifelong crusader on campus sexual assault, chaired the Committee to Recall Judge Persky. The online petitions to remove Persky had gathered over a million signatures by June 10, 2016.
They demanded Persky’s resignation be revoked. Perksy was recalled by county voters on June 5, 2018. Persky received 38.49 percent of the vote in the recall election, compared to 61.51 percent in the previous election. In 86 years, Persky became the first judge in California to be recalled by voters. He was also the first judge to be appointed in the United States since 1977.
Aftermath:
Palo Alto Online and BuzzFeed published a 7,138-word victim impact statement online on June 3, 2016. In just three days, the remark went viral on social media, garnering 8 million views. The statement was later formally disseminated by Santa Clara County.
Turner filed an appeal in December 2017 to have his sex offender registration revoked for the remainder of his life. On August 8, 2018, he lost his appeal to reverse the decision. In September of this year, Miller disclosed her true identity. She also revealed that on September 24, she will publish Know My Name: A Memoir, a book about her experience with the assault, trial, and aftermath.
