Sexual Assault Incident:

Peter Lars Jonsson and Carl-Fredrik Arndt, two Swedish graduate students, were riding by the Kappa Alpha fraternity on the Stanford campus at 1:00 a.m. on January 18, 2015. They discovered Turner on top of a lady who was unconscious behind a trash. Turner was asked by Jonsson “What are you doing with your life? She is a woman who is unconscious “.. Turner then bolted. Arndt went to see if the woman was still breathing. Turner was being pursued by Jonsson at the same time. Turner was tripped and held down 75 feet from the dumpster by Jonsson. Turner was also pursued by Arndt, who assisted Jonsson in pinning him down. When a passer-by near the dumpster contacted 911, campus police arrived and detained Turner.

At 4:15 a.m., the victim woman was rushed to the hospital and recovered consciousness. The hospital’s Sexual Assault Response Team assessed that she had suffered considerable trauma (physical harm, bruises, etc.) as well as penetrating trauma (piercing and cutting injuries). Her skin was determined to have abrasions and erythema.

Turner and the victim had previously attended a party at the Kappa Alpha fraternity on January 17, 2015.

Turner dropped out of Stanford after the event. On the 20th of January, Stanford announced that Turner had been expelled from the university. He was also barred from ever representing the United States in a competitive swimming event.

Indictment and Charges:

Turner was charged with five counts on January 28, 2015. He was charged with rape on two counts, penetration on two counts, and assault with the intent to rape on one count.

1. Harassment of a drunken person.

2. rape of a person who is unconscious.

3. sexual invasion of an unconscious woman (by a foreign object).

4. sexual penetration of an inebriated woman (by a foreign object).

5. Assault with the intent to rape

After DNA testing revealed no genetic evidence of genital-to-genital contact, the two counts of rape were dropped at a preliminary hearing on 7 October 2015. In March 2016, the People filed Motions in Limine and Witness List, which outlined the trial’s admissible evidence criteria.

Trial, Sentence:

The trial started on March 14, 2016. Turner stated that he met the victim (then known as Emily Doe) at the Kappa Alpha residence and that the two of them shared a beer. At the party, they danced and kissed and agreed to return to his room. They held hands as they walked out from the house. Turner got down on the ground and began kissing the victim after the victim stumbled on a hill behind a wooden shed. She responded yes when Turner asked if she wanted him to “finger” her. He then “fingered” her for a minute, he said.

Turner was then approached by the Swedish students. Turner denied that he was fleeing graduate students. He also indicated that he had no idea what they were discussing.

On March 30, 2016, Turner was found guilty of three felonies. He was found guilty of sexually penetrating an intoxicated person with a foreign object, assault with intent to rape an intoxicated woman, and sexually penetrating an unconscious person with a foreign object. Turner was recommended for a six-year prison sentence by prosecutors. Judge Aaron Persky, on the other hand, sentenced Turner to six months in the Santa Clara County jail, followed by three years of probation, on June 2, 2016. After three months in prison, he was freed on September 2, 2016. He was required to take part in a sex offender treatment program.

Controversy:

Turner’s sentencing by Judge Persky drew great public condemnation. Judge Persky’s sentencing was attacked by prosecutors and victims’ rights groups as mild and biased. Turner was a candidate for a minimum sentence because of his previous clean record.

Michele Dauber, a Stanford Law School professor and lifelong crusader on campus sexual assault, chaired the Committee to Recall Judge Persky. By the 10th of June 2016, online petitions to remove Persky as the Judge had gathered over a million signatures. They requested that Judge Persky be removed from office or resign.

On June 5, 2018, county voters called for Persky to be recalled. With a vote of 38.49 percent to 61.51 percent, he lost the recall election by more than 23%. He was the first judge in California in 86 years, and the first in the United States since 1977, to be recalled by voters.

Emily Doe Revealed her Identity:

In September 2019, Emily Doe, a witness in the case, disclosed her true name. Chanel Miller is her true name. She revealed that she is working on a memoir called Know My Name: A Memoir. The book is set to be released on September 24, 2019. In her memoir, she talks about the assault, the trial, and the aftermath.
